Arsalan suo moto hearing adjourned
ISLAMABAD: A two-member bench of the Supreme Court heard the Arsalan Iftikhar suo moto case on Tuesday. Both Malik Riaz and Arsalan Iftkhar were present in the court along with their counsels.
During proceedings, Justice Jawwad SKhawaja remarked that if he could not defend the allegations leveled against the institution, there was no point in him being part of the Supreme Court.
To this, Riaz’s counsel Zahid Bukari said that it seemed like the Supreme Court had made up its mind to which Justice Khawaja replied that his mind would not be made up until he signed on the court order.
Zahid Bukhari also said that his client had been given no exceptions by the Supreme Court as Malik Riaz’s record had been summoned from the FBR along with other institutions, while no records of Arsalan Iftikhar were summoned.
Bukhari also put forward three options for the Supreme Court. Bukhari said that the Supreme Court should form a larger bench to hear the case. The second option put forward by Bukhari was that a commission similar to the one which probed the memo scandal be formed, while the third option states that the court should send the case to an investigation agency.
Earlier today, Malik Riaz had submitted a statement to the SC which claimed that Rs 342.50 million were spent on Dr Arsalan Iftikhar’s three foreign tours.
The statement added that Dr Arsalan claimed that he could settle the cases fought in his father’s court in favour of Bahria Town, however this did not happened.
The Supreme Court has adjourned the hearing of the Arsalan Iftikhar suo moto case till 14th June.

Malik Riaz says Arsalan swindled Rs340m
ISLAMABAD: Malik Riaz statement submitted to the Supreme Court said that Rs 342,501,254 were spent on Dr Arsalan Iftikhar’s three foreign tours, Geo News reported.
The statement added that Dr Arsalan claimed that he could settle the cases fought in his father’s court in favour of Bahria Town but that not happened.

A two-member bench is hearing the Arsalan suo moto case.
Real estate tycoon, arrived at the SC building today to appear before the court for the first time since the matter flared up earlier this month.
Documents presented as witness in the SC showed that Dr Arsalan’s first visit in 2010 cost Rs8, 860,579. Rs2,284,829 for tickets and tours to Monte Carlo and Rs6,575,750 for car and flat rental fees and shopping.
Second tour that took place in 2011 cost Rs692,949 on account of hotel expenses. All the visits were made to London.
Another tour in 2010 cost Rs5,947,726. Rs3,433,136 were spent on cash, vehicle lease and hotel while Rs2,514,590 were paid for apartment rented.
Rs327,000,000 were also paid to him on various accounts in the form of cash, the statement said.
In his affidavit, Riaz reiterated that he was being “blackmailed” by Arsalan and was forced into going public. He declined any involvement of any political party or the Army in the entire case.
Malik Riaz also challenged the suo moto notice taken by the chief justice. ‘That the Suo Moto action taken by the Honorable Chief Justice of Pakistan is not legal. No question of enforcement of any fundamental rights has arisen.’
‘That constitution of Bench is always an administrative action and the formation of a new bench was essential after the quittal of Honorable Chief Justice of Pakistan from a bench of 3 Honorable Judges, thereafter, the same matter cannot be heard and disposed off by a Bench consisting less than 3 Honorable Judges.’

About how the contacts between Dr Arsalan and his family developed, Malik Riaz said: “That Ahmed Khalil is a friend of Dr Arsalan. Salman Ahmed Khan, my son-in-law is also a friend of Ahmed Khalil, who introduced Dr Arsalan Iftikhar with Salman Ahmed and from there relations between the two developed”.
The real estate magnate also blamed the CJ’s son for blackmailing his son-in-law and extorting money.

Arsalan case: Ali Riaz submits statement
ISLAMABAD: The chief executive of Bahria Town, Ali Riaz Malik has submitted his statement regarding the Arsalan Iftikhar suo moto case in the Supreme Court (SC), Geo News reported Tuesday.
Ali Riaz’s statement was submitted by his counsel Ali Zafar in which he has showed ignorance over the deal between Malik Riaz and Arsalan Iftikhar.
The statement said that Ali Riaz was appointed as Bahria Town’s chief executive in July 2008 and that Malik Riaz’s shares were transferred to Mrs Bina Riaz on May 14, 2012.
The statement further said that the Bahria Town is neither involved in any illegal money transfer or business deal between the two (Malik Riaz and Dr Arsalan) nor Bahria Town, Ali Riaz, Bina Riaz have leveled any charges against Arsalan Iftikhar.
The management reserves the right to respond if allegations are levelled against Bahria Town, the statement said.
The charges imposed by Shaheen Sehbai, Hamid Mir and Kamran Khan against Bahria Town are false and they referred to an individual act. These allegations carry no authenticity as far as Bahria Town is concerned, the statement added.
Ali Riaz said that Bahria Town is a corporate entity and pays all the taxes and duties.

Trial will prove if Arsalan case is a conspiracy: Supreme Court
ISLAMABAD: The Supreme Court on Monday said if the graft allegations against Arsalan Chaudhry, the son of Chief Justice Iftikhar Muhammad Chaudhry, were a conspiracy, it would be proven during the course of the trial. It also ordered that a security detail be attached to Arsalan while directing Malik Riaz Hussain to submit his reply today (Tuesday).
Meanwhile, relevant documents of Bahria Town were handed over to the SC Registrar. A two-member bench of the apex court comprising Justice Jawad S Khawaja and Justice Khilji Arif Hussain heard a suo moto case on an alleged business deal between real estate tycoon Malik Riaz Hussain and Arsalan.
The court directed Attorney General Irfan Qadir to ensure security to Arsalan. The AG assured the court that he would contact the Interior Ministry in this regard.
The court gave the orders for a security detail after the CJ’s son, through his counsel Sardar Ishaq, had requested the court that as his father had barred him from the family residence, he should be provided security because Malik Riaz or anyone else could harm him. He had contended in his application that the federal and provincial governments, in view of impending threats, had conveyed to him in both Islamabad and Lahore to be careful in his movements.

Citing the case of Salmaan Taseer, Arsalan recalled that when his family was left without any security in Lahore after the death of the Punjab governor, his son was abducted and his whereabouts were unknown. He also cited the case of the kidnapping of son-in-law of the former Joint Chiefs of Staff Committee chairman. Therefore, he contended that it was the responsibility of the state to protect him, urging that appropriate directions be issued to the federal and provincial governments to provide him security.
At the outset of the hearing, Arsalan appeared before the court and referred to a programme aired on Geo TV and conducted by Sana Bucha, which was attended by four journalists, including Najam Sethi, Saleem Safi, Iftikhar Ahmed and Hamid Mir. He informed the court that Hamid Mir stated in the said programme that Malik Riaz had told him he had videos as well as pictures of his mother and sisters. Arsalan contended that these videos pertained to the period during which his mother was in London along with other family members. Arsalan insisted that the script of the said programme be called for and on having verified the fact, direction be issued for registration of a criminal case against Malik Riaz Hussain.
As Arsalan asked the court to take action against Malik Riaz, the court ordered him to remain patient and speak through his counsel who had appeared on his behalf. Justice Jawad S Khawaja asked Sardar Ishaq to guide Dr Arsalan. “This is not the manner, the way you are talking before the court. Enough is enough,” he said, reprimanding Arsalan.
During the hearing, the court also directed Zahid Bukhari, the counsel for Malik Riaz Hussain, to file a reply on behalf of his client by June 12, also directing Ahmed Ali Riaz Malik, the son of Malik Riaz Hussain, to appear before the court on June 12. Zahid Bukhari assured the court that Malik Riaz would not take any step to harm Arsalan Iftikhar.
He also sought two days for the reply of Malik Riaz Hussain who, he argued, was ill. The court, however, directed him to file the reply by June 12 and adjourned the case till Tuesday (today).
During the course of proceedings, Justice Khawaja said that till now the case was based only on the allegations of a few people, out of which two, including Geo News senior anchors Hamid Mir and Kamran Khan, had already recorded their statements in the court. There were three others, the court said, who had alleged that money was given to Arsalan Iftikhar. Justice Jawad added that if this was a conspiracy, it would be proven during the course of the trial.
Barrister Ali Zafar, the counsel for Bahria Town, while appearing before the court submitted that Secretary Bahria Town could not appear in the court. At this, Justice Jawad remarked that this was a court and should not be turned into Bahria Town.
The court also noted that the Federal Board of Revenue (FBR) chairman had sent under sealed cover the income tax returns of Malik Riaz Hussain till 1996 and stated that records for the following years were not available. Later, Mohammad Aqil Usman, FBR member legal, told the court that they had arranged the available material on an emergency basis in compliance with the court’s order.
The court, however, observed that Malik Riaz remained the Bahria Town chairman till May 15, 2012 and directed that the tax returns of Bahria Town and the partnerships till May 15, 2012, be submitted today (Tuesday).
Online adds: The Supreme Court office on Monday rejected Arsalan Iftikhar’s plea seeking the registration of a case against Malik Riaz, arguing that since the court was hearing the case, the plea could not be entertained.

‘Made CJ aware of Arsalan’s activities’
ISLAMABAD: Barrister Aitzaz Ahsan has confirmed that he had informed the Chief Justice about the rumours doing the rounds about Dr Arsalan Iftikhar’s dubious business transactions with Malik Riaz Hussain, Geo News reported.
While talking to Geo News Aitzaz after a blistering press conference of real estate tycoon Malik Riaz, he said he had told the CJ about the sensitivity of the matter but did not show any documents to him in this regard.
The allegations are of serious nature, Aitzaz said adding that he did not follow up with the chief justice on the issue afterward.
‘Malik Riaz had shown me the documents some time ago and it was my duty to inform the CJ about it. He thanked me for coming and said he would ask Arsalan about this.’

Arsalan suo moto case: CJ detaches himself from bench
ISLAMABAD: Chief Justice of Pakistan Iftikhar Muhammad Chaudhry has detached himself from the three member bench hearing the suo moto case against Dr Arslan Iftikhar in the Supreme Court of Pakistan.
“I have faith in the Supreme Court judges,” Chief Justice remarked.
Attorney General Irfan Qadir, addressing the chief justice during proceedings had again argued that he could not be part of a bench hearing his own son’s case.
The hearing of the case has been adjourned till 1 PM which is when the two remaining judges on the bench will resume hearing.
Geo News Chief Executive along with senior anchor Kamran Khan who had been summoned on Wednesday, also arrived at the apex court. Kamran Khan described details of the documents he had seen pertaining to the case. He said that he had seen the record of Arsalan Iftikhar’s travel details including the copy of his passport and receipts.
According to Karman Khan these documents were shown to him by Malik Riaz, however he was not provided with any copies. Elaborating further, Kamran Khan said Malik Raiz told him that these documents were also shown to Aitzaz Ahsan.
Speaking to the media prior to the start of proceedings, Zahid Bukhari the counsel for Malik Raiz said his client would not be present at the Supreme Court because he was receiving medical treatment abroad.
Earlier on Wednesday, Chief Justice Iftikhar Muhammad Chaudhry said that anyone who had conspired to malign the judiciary would not be spared, adding that his son Dr Arsalan Chaudhry will be punished if he will be found guilty.
Dr Arsalan has, meanwhile, denied the allegations of corruption that have circulated in the media in recent days.
